The Importance of Engagement and Disengagement Letters for Lawyers
Moderator:
Joseph H. Jones, Jr., Esq., Director of Risk Management, Travelers
Speakers:
Bryan Jordan, Managing Director & Counsel, Professional Liability Claims, Travelers, and David Corbett, Esq., Litchfield Cavo
A well-crafted engagement letter can be a very effective tool for avoiding and defending malpractice claims and ethical complaints because it frames the expectations and responsibilities between lawyer and client so as to avoid ambiguity. Equally important is a disengagement letter when a firm must cease representation of a client or needs to withdraw from representation. Failure to properly engage and disengage clients can lead to misunderstandings, confusions, and potentially claims.
