Responsible Use of AI in Legal Research and Writing – Sample Template Policy
Applies To: All attorneys, paralegals, interns, and staff using AI tools for legal work.
1. Purpose
This policy governs the use of generative artificial intelligence (AI) tools in legal research, drafting, and communications to ensure accuracy, client protection, and compliance with professional standards.
2. Approved Use Cases
Use AI tools with verification for the following:
• Drafting outlines or rough legal memos.
• Brainstorming argument structures.
• Summarizing existing cases or statutes from verified sources.
• Generating email drafts or non-substantive correspondence.
3. Prohibited Uses
Do not use AI tools to:
• Cite legal cases, statutes, or regulations without independent verification.
• Draft legal filings for submission without full attorney review.
• Replace traditional legal research through Westlaw, LexisNexis, or court records.
• Generate client advice or legal opinions without attorney oversight.
4. Hallucination Warning
Generative AI tools are known to:
• Fabricate case citations and docket numbers.
• Invent statutory language or legal standards.
• Misattribute quotes or holdings from unrelated cases.
Treat all AI outputs as unverified until cross-checked using official legal databases.
5. Review and Accountability
Before including AI-assisted content in client-facing work:
• An attorney must review all content manually.
• Any AI-generated legal citations must be verified through a licensed legal database.
• A short note should be added to internal records noting AI assistance (e.g., “Initial draft generated with AI – verified and reviewed by [Attorney Name]”).
6. Tools Allowed
Permitted tools (use in compliance with the above sections):
• ChatGPT, Copilot, or other LLMs: Only for brainstorming or drafts.
• Westlaw AI Assist, Lexis+ AI: Allowed for verified legal research with proper source linking.
Any use of external or free AI tools must not involve confidential or privileged data.
7. Confidentiality & Data Privacy
• Do not input client names, case details, or personal information into public or free AI tools.
• Use only firm-approved platforms for sensitive or privileged content.
8. Training & Updates
• All staff must complete AI ethics and verification training by [Insert Date].
• Review this policy on a quarterly based on case law and Bar guidance.
9. Acknowledgment
